SPK Fatigue Modeler ("the Service") provides bio-mathematical fatigue-risk modeling and schedule analysis for informational and decision-support purposes only. The Service does not assess, determine, or certify an individual's fitness for duty or operational readiness.
1. Not a Determination of Fitness for Duty
The outputs generated by the Service, including fatigue scores, risk indices, alertness estimates, or any related analytics:
- Do not constitute a medical evaluation
- Do not determine fitness for duty, clearance for safety-critical work, or suitability for operational tasks
- Must not be used as the sole basis for personnel decisions, including assignment, removal, discipline, or certification
Decisions regarding staffing, scheduling, medical evaluation, or operational safety remain strictly the responsibility of the user and their organization.
2. Advisory Use Only
All model outputs are advisory and are intended to support—but not replace—professional judgment, organizational policies, internal fatigue-risk management systems (FRMS), regulatory requirements, or operational procedures.
Users must consider:
- Individual differences in sleep, health, workload, and personal readiness
- Task demands and operational context
- Environmental factors not captured by the model
- Applicable laws, regulations, and certification standards
3. No Guarantee of Accuracy or Safety Outcomes
While the Service applies scientifically grounded fatigue modeling methods, no model can perfectly predict human performance or guarantee the absence of fatigue-related risk.
You acknowledge that:
- Model outputs may contain uncertainty, estimation error, or incomplete information
- The Service cannot detect real-time impairment
- Fatigue risk may arise from factors outside the scope of schedule-based modeling
- Operational incidents may still occur regardless of model outputs
4. Not a Medical, Clinical, or Diagnostic Tool
The Service does not provide:
- Medical advice
- Clinical evaluation
- Diagnosis or treatment of sleep disorders
- Occupational health assessments
- Any service regulated as a medical device
Individuals with health or sleep concerns should consult qualified medical professionals.
5. User and Organizational Responsibility
Users and organizations remain fully responsible for:
- Interpreting outputs appropriately
- Verifying accuracy of uploaded schedules and operational data
- Applying internal risk-management processes
- Ensuring compliance with regulatory requirements (FAA, OSHA, FRA, ICAO, EASA, etc.)
- Making operational and staffing decisions
- Maintaining adequate supervision and oversight
The Service is a tool—not a substitute—for comprehensive fatigue-risk management and operational safety practices.
6. No Liability for Operational Decisions
Fort Hill Group and its affiliates shall not be liable for:
- Operational decisions based on model outputs
- Accidents, incidents, or safety events involving personnel or equipment
- Misinterpretation or misuse of fatigue-risk estimates
- Use of the Service in contexts beyond its intended purpose
